Mortgage industry disputes have become a highly contentious issue in recent years, and a court battle between HomeServices of America Inc. and two of its former sales branches is now approaching a trial date in October. The matter has long revolved around a commission dispute and Home Services recently lost an appeal in relation to this.

The dispute between HomeServices of America and the Indiana-based brokerages has been ongoing for close to seven years, having initially been filed in 2014. It has since been winding its way through the courts, first being dismissed in the District Court and then affirmed by the 7th Circuit Court. As HomeServices of America failed to prove that the sales branches’ involvement in commission disputes was not subject to the Indiana Legislature’s non-compete clauses, the 7th Circuit Court dismissed the appeal. This sets the stage for the matter to now be brought before a jury in October.
